JD(U) GENERAL SECRETARY ACQUITTED WHILE NINE WERE AWARDED RI IN ICHARI CARNAGE AFTER 30 YEARS
-Additional District and Session Judge III, Ara Civil Court Satyendra Singh acquitted the General Secretary, Janata Dal (United) and former minister Sri Bhagwan Sinngh Kushwaha for want of evidences on one hand while on other awarded rigorous life imprisonment to nine persons under section 302/149 IPC and also slapped a fine of Rs. 10,000 on each of them in connection with carnage on March 29, 1993 at Ichari village under Ayar police station. The RI was awarded to Rajendra Sah, Dular Chandra Sah, Bandhu Sah, Baleshwar Ram, Bharosa Ram, Bahadur Ram, Satya Narayan Ram, Police Mahato and Gauri Mahato.
Ara, 6 April 2023, (RNI): Additional District and Session Judge III, Ara Civil Court Satyendra Singh acquitted the General Secretary, Janata Dal (United) and former minister Sri Bhagwan Sinngh Kushwaha for want of evidences on one hand while on other awarded rigorous life imprisonment to nine persons under section 302/149 IPC and also slapped a fine of Rs. 10,000 on each of them in connection with carnage on March 29, 1993 at Ichari village under Ayar police station. The RI was awarded to Rajendra Sah, Dular Chandra Sah, Bandhu Sah, Baleshwar Ram, Bharosa Ram, Bahadur Ram, Satya Narayan Ram, Police Mahato and Gauri Mahato.
Public Prosecutor, Nageshwar Dubey said that about one and half a dozen supporters of the Bharatiya Janata party were returning their native village at Ichari under Ayar police station on tractors after attending a meeting at Jagdishpur on March 29, 1993 and when they reached near Gosai Mor near Ichari village, some armed miscreants of Ichari village sprung up from the wheat field nearby and attacked the supporters and activists of the BJP. They fired indiscriminately killing five of them and injuring nine seriously. A named FIR 41/1993 was lodged with the police under Jagdishpur police against 29 persons including Sri Bhagwan Singh Kushwaha who was at that time the MLA of the CPI-ML on the statement of one of the injured Gupteshwar Singh. It was said in the FIR that Sri Bhagwan Singh was the main conspirator and instigator. Gupteshwar Singh said that his nephew and former Mukhia Binod Singh look after the case who was murdered in the year 2013.
Binod Kumar, advocate of the Sri Bhagwan Singh Kushwaha said that the police had removed the name of Sri Bhagwan Singh Kushwaha after interrogation for want of evidence from the charge sheet but the accused demanded trial against Sri Bhagwan Singh Kushwaha and the court issued summon against him under section 319 CrPC but again the court acquitted him for want of evidences. Binok Kumar further said that Sri Bhagwan Singh Kushwaha was made accused in the case under section 120B of the IPC but the police found no evidence against him.
