INSTRUCTIONS TO CLOSE ILLEGALLY OPERATED PATHOLOGICAL TESTING CENTRES HAVE NO IMPACT

Ara (RNI): Many pathological testing centres are still being run illegally in violation of the instruction of the Health Department. As a result, the patients are being cheated on one hand while on the other, the government is suffering loss of revenue but no action is being taken against the illegal pathological centres.  

The erstwhile, Civil Surgeon, Ara Sadar Hospital, A L Jha had directed to close 31 pathological testing centres which were running illegally and a case CWJC 20444/2014 was also filed in the Patna High Court regarding this. The pathological testing centres operating against the provision of Clinical Establishment Registration and Regulation Act 2010 and the Rule 2012/18, were declared illegal and directed to be closed. In the course of hearing in Indian Association of Pathologists and Microbiologists Bihar Chapter VS State of Government of Bihar and others, instructions were given to close the illegal centres. In compliance with the other of the court, the concerned testing centres were declared illegal and directed to be closed.

Despite, Pathological testing centres were being run against the rules. The Health Department had given notice to these centres and had given instructions to submit the documents as per the prescribed criteria but the required documents were not submitted by the concerned centres and so these centres were declared illegal and instructed to be closed. The Health Department instructed if the said centres are found to be operating illegally, criminal action will be taken against them as per rules but no action has so far been taken against these centres and still these centres are running with impunity right under the nose of the officials of the Health Department.

Civil Surgeon, Bhojpur, Dr. Suresh Prasad Singh said that if again the work is being done by these pathological testing centres, it will be investigated and action will be taken in the light of the rules and added that arbitrariness will not be tolerated under any circumstances.
