BUXAR---------------------------Buxar District and Session Judge, Buxar Civil Court, Anand Nandan Singh awarded life imprisonment to five persons in connection with murder of a person about 37 years ago.
APP Aditya Kumar Verma said that Markandey Singh son of Ramvriksh Singh of Brahmpur village under the same police station in Buxar district was taking tea at about 8.30am on October 24, 1987 when Dinanath Singh of the village informed him that Suendra Mohan Singh, Shatrunjay Singh, Shambhu Singh, Shiv Pratap Singh and Jitendra Chaurasiya were taking away tables, chairs and other articles from his office. Markandey Singh along with others rushed to the office when Surendra Mohan Singh and others started indiscriminate firing and in the process, Dinanath Paswan received bullet and was shot dead while some others were injured. A named FIR was lodged with the police against them under Brahmpur police station on the statement of Markandey Singh. The police investigated the matter and submitted a charge-sheet against nine persons in the court. During hearing of the case, the court framed charges under the relevant statutes besides section 304 IPC. After the Patna High Court instructions, the trial was started by framing charges under 302 and other relevant statutes in place of 304.
After hearing both the parties, the District and Session Judge, Buxar Civil Court Anand Nandan Singh found Surendra Mohan Singh, Shambhu Singh and Shiv Pratap Singh guilty under 27(1) Arms Act and awarded seven years imprisonment and also slapped a fine of Rs. 10000 on each of them. The court awarded three years imprisonment to Surendra Mohan Singh, Shambhu Singh, Shiv Pratap Singh and Jitendra Chaurasia under section 324 IPC and also awarded life imprisonment to all the five and also slapped a fine of Rs. 25,000 on each of them under section 302/149. The court also awarded 10 years imprisonment to all of them and slapped a fine of Rs. 10,000 on each of them under section 307/149 IPC and also awarded three years imprisonment to them under secion 148 IPC. Mrityunjay Singh, Sitaram Paswan and Manan Ahir had died during pendency of the case.
