COURT TAKES STERN ACTION AGAINST THE POLICE OFFICERS INCLUDING ROHTAS SP

Sasaram, 13 June 2023, (RNI): Judicial Magistrate, Ist Class, Sasaram Civil Court, Nivedita Kumari sent the Station House Officer, Sasaram Town police station to jail for two days for dereliction of duty and also served show cause notice of the Rohtas Superintendent of Police.

The court had ordered to submit report in the court in the case No 1018/2005 in connection with murder of Sanjay Kumar Srivastava and Bharat Prasad Srivastava of Mahavir Sthan Kuraich village but the the SHO did not submit the report and the court had earlier slapped a fine of Rs. 5000 on him. Despite the SHO did not abide by the order of the court. And so the court sent the SHO, Sasaram Town Station to jail for two days under section 175 IPC.

The court also ordered to issue non-bailable warrant against the SHO and order the Rohtas SP to serve the order by June 19, 2023 at any cost so that the SHO can undergo two day jail. The court also served show cause notice on the Rohtas SP asking him as to why he did not deposit Rs. 5000 in the District Legal Service Authority by deducting the same from the salary of the SHO and also did not submit the report.

Besides, the Additional District and Session Judge ordered a Sub-Inspector Gautam Kumar posted at the Sasaram Town police station to be present in person in the court. The SHO Sasaram Town police station made Gautam Kumar the Investigation Officer (IO) of the case No 925/2022.

The court during hearing of bail petition of four persons including Muni Lal in case No 925/2022 had demanded court diary on November 7, 2022 but the IO did not submit the case diary in the court despite several correspondence while the High Court had fixed the maximum time limit of six weeks for the hearing on the anticipatory bail petition. The court said that now six months expired and it is matter of disobedience of the order of the High Court. The IO is responsible for it and so his salary is withheld till further order and also served show cause notice on him in this regard. The court ordered the SP withheld salary of the IO and inform the court. The court also ordered the IO to be present with latest case diary physically in the court otherwise legal action would be initiated against him.

Additional District and Session Judge IV, Rohtas Civil Court, Manoj Kumar withheld salary of the SHO, Bikramganj police station during hearing of an anticipatory bail petition in the case No 486/2022. The court was demanding the case diary for long but the SHO turned deaf year. The court had also issued show notice on him in this regard earlier.
