CJM, ARA CIVIL COURT ISSUES SUMMON AGAINST THE TAMIL NAIDU MINISTER FOR HATRED SPEECH AGAINST SANATAN DHARM
Chief Judicial Magistrate, Ara Civil Court, Manoj Kumar Jha ordered to issue summon against the accused Udaynidhi Stalin under section 298 IPC in complaint case No 1524©/2023. The court directed the complainant to file essential requisites within 15 days for issuance of summons against the person named in the complaint petition and thereafter office is directed to issue summon against the accused person. The court found sufficient material to proceed under section 298 IPC against accused person namely Udaynidhi Stalin, Minister of Youth Welfare and Sports Development and son of Tamil Naidu Chief Minister M.K. Stalin.

A complaint case was filed in the court of the Chief Judicial Magistrate, Ara Civil Court under section 120 (B), 153(A), 153(B), 295(A) and 298 IPC against Udaynidhi Stalin, Minister of Youth Welfare and Sports Development and son of Tamil Naidu Chief Minister M K Stalin for his hate speech against the Sanatan Dharma. Advocates Aditya Narayan Singh, Lavkesh Kumar Singh, Sudha Shankar Tiwari, Narendra Rai and others were made witnesses in this complaint case. He requested the court to take exemplary action so that the petitioner could get justice.
Advocate, Ara Civil Court, Dharnidhar Pandey, in his complaint petition said that he is follower of Sanatan Dharma and is deeply hurt by Udaynidhi Stalin’s statement against the Sanatan Dharma. He said that Udaynidhi’s speech has hurt religious sentiments, insulted the followers of Hindu religion and also created discrimination between groups on the basis of religion.
Dharidhar Pandey said in his complaint petition that Uday Nidhi who is holding the post of Minister of Youth Welfare and Sport Development in the government of Tamil Naidu, was present in the Sanatan Elimination Symposium at Chennai on September 1, 2023 where he, addressing the crowd with criminal intent, compared the Sanatan Dharma with Corona Virus, Dengue and Malaria and expressed the desire to eradicate it and thus inciting the public with malicious spirit and defamatory speech that adversely affect national unity and integrity by supporting enmity between classes. In the complaint petition the advocate said that Uday Nidhi Stalin has been accused of hurting religious sentiments, inciting hatred, creating class discrimination and disturbing unity and integrity of the nation. Dharnidhar Pandey further said that he went through the newspapers on September 5, 2023 at his residence in the presence of the witnesses and also watched Uday Nidhi Stalin on TV spewing venom against the Sanatam Dharma that hurt him a lot.
It is worth mentioning here that Uday Nidhi, while speaking at a programme in Tamil Naidu, had said that Sanatan Dharma will be destroyed like mosquitoes, Dengue, Malaria or Corona virus. The Sports and Youths Affairs Minister of Tamil Naidu had said that instead of opposing Sanatan Dharma, it has to be abolished because it divides people into castes and promotes discrimination. Uday Nidhi refused to apologize for his comment and justified his statement by saying that he would say this continuously.
